Pre-Bankruptcy Counseling Client Disclosure for Self Study

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) requires that you attend a counseling/briefing session by an agency approved by the Executive Office of the United States Trustees (EOUST) prior to filing for bankruptcy. Approval by the EOUST does not endorse or assure the quality of the agency’s services. ClearPoint bankruptcy counseling services will enable you to earn a certificate that meets the requirements of BAPCPA.

 

The counselor conducting or supervising your session has been trained and certified but he/she cannot provide you with legal advice. This session is designed to provide you with information and alternatives; it is not intended to take the place of a consultation with an attorney to explore your legal rights and options. Specifically, your counselor with provide you with information about bankruptcy, including its process and possible consequences, and possible alternatives. The purpose of this session is to provide you with information so that YOU may choose the option that you think is best. At the conclusion of this session, you will be provided with a certificate that you will need should you decide to file for bankruptcy.

 

To enable us to assist you, it is essential that you provide us with information that is as accurate and complete as possible. Information concerning your financial situation that you provide during this session is strictly confidential. Such information may include, but is not limited to, income, debts, credit accounts, earnings, assets, and employment data. ClearPoint Financial Solutions will not disclose any such information that you provide orally or in writing to anyone, except as authorized by you in writing or as required by law. You authorize ClearPoint Financial Solutions to send pertinent data to your bankruptcy attorney as needed. ClearPoint Financial Solutions may compile aggregated client data, but individual client information will not be disclosed in any manner that would personally identify you. This agency will not disclose or provide any information about this session to a credit reporting agency. If you decide to enter into a Debt Management Plan (DMP) (which will be explained in the course of this pre-bankruptcy counseling session), you will be provided with a separate agreement and disclosure forms.

 

ClearPoint Financial Solutions charges each client. In those cases where it is established that a consumer is unable to afford the cost for bankruptcy counseling or bankruptcy related financial education, the agency will, on a case-by-case basis, provide service at a reduced price or in accordance with our fee waiver policy, for free. Fee structure outlined below.

This agency also receives funding in the form of grants from HUD and major creditors. A significant portion of funding for this agency comes from voluntary contributions from creditors who participate in DMPs. Since creditors have a financial interest in having debts repaid, most are willing to make a contribution to help fund the overall services of this agency. These contributions are usually calculated as a percentage of payments that are made through a DMP (up to 15%). Again, should you decide to enter a DMP you will receive specific information on how the plan works and how the agency is funded.
